SHOOT "BEHIND THE SCENES" PHOTO CONTEST OFFICIAL RULES
Don't be disqualified! Read these important rules before entering. Participation in this Contest is subject to the official rules.

This "BEHIND THE SCENES" PHOTO CONTEST (the Contest) is produced by SHOOT (the Producer), a DCA Business Media LLC media property, mailing address is 256 Post Road East, Suite 206, Westport, CT 06880, website SHOOTonline.com, and email firstname.lastname@example.org. Please address all mail to "SHOOT BTS Photo Contest."
Entrants acknowledge that this Contest is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Twitter. Entrants acknowledge that any information they provide in connection with the Contest is provided to the Producer and not to Facebook, Instagram, or Twitter. Any questions or comments regarding the Contest must be directed to the Producer; not to Facebook, Instagram, or Twitter. Entrants release Facebook, Instagram and Twitter and its associated companies from any and all liability claims arising in respect of the Contest.
All entries are subject to verification by the Producer. Entries that do not meet the requirements for the specified below or otherwise do not comply with the Official Rules herein may be disqualified. Any attempted form of entry other than as described herein is void. And will be blocked. Producer will determine in its sole discretion, what constitutes a valid entry. All materials submitted become the property of the Producer and will not be returned or acknowledged.
The Producer reserves the right to request verification of age, identity, residential/business address and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Producer, whose decision is final. The Producer reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this promotion.
In order to enter the Contest, you must agree to these Official Rules (“Rules”). Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Rules. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and Producer with respect to the Contest.
ELIGIBILITY of IMAGES
Each entered photo must comply with the terms and conditions set forth in the Official Rules. Only digital entries submitted through SHOOT's website at http://BTS.SHOOTonline.com, SHOOT's Facebook page (http://BTS-FB.SHOOTonline.com) and if using mobile device (i.e. smartphone, tablet) here as well (http://BTS-FB.SHOOTonline.com) Only online entries will be eligible. No physical print (hard copy) or slides submissions will be accepted for entry into the Contest. Mail-in entries are not available for this contest.
ELIGIBILITY OF PARTICIPANTS
To be eligible to enter the Contest, you must be: (1) 18 years or older on the submission date., (2) If a photographer and/or potential winner is a minor, his/her parent or legal guardian is required to make entry on behalf of minor and will be required to sign any required documents on his/her behalf., (3) not participating or voting from Afghanistan, Islamic Republic of, Bangladesh, People's Republic of,Haiti, Republic of,Trinidad and Tobago, Republic of,Tokelau,Myanmar, Union of,Malaysia,Nigeria, Federal Republic of,Philippines, Republic of the,Pakistan, Islamic Republic of,Rwanda, Republic of,Singapore, Republic of,Thailand, Kingdom of,Taiwan, or Vietnam, Socialist Republic of; To make clear, we will not transact within those jurisdictions for various legal reasons, but if a resident of those jurisdictions participates outside of those regions it is acceptable. The Producer reserves the right to verify eligibility and to adjudicate on any dispute at any time.
Employees and their relatives of the Producer, DCA Business Media LLC dba SHOOT and SHOOTonline and each of their respective affiliates, subsidiaries, advertising or promotion agencies, and SHOOT freelance professional photographers are not eligible. Employees and their relatives of any and all Sponsors, and each of their respective affiliates, subsidiaries, advertising or promotion agencies, and freelance professional photographers are not eligible. Void where prohibited by law.
The Contest is open to any professional, amateur or student photographer. The Contest is subject to all applicable international, federal, state and local laws in each jurisdiction where residents are eligible to participate in the Contest and void in any jurisdiction where otherwise prohibited or restricted by law.
There is NO PURCHASE OR ENTRY FEES REQUIRED to enter this contest.
By submitting photo(s) to the competition, the entrant gives permission for the image to be used by SHOOT on any Contest publicity material, including digital and print.
Closing times for entry will be Midnight ET as per below dates. After these dates/times no further entries to the current Summer or Winter contest will be permitted.
No responsibility can be accepted for entries not received for whatever reason.
The producer reserves the right to cancel or amend the competition and these terms and conditions without notice.
The producer is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this competition.
No cash alternative to the non-cash prizes will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.
The winners will be chosen by the Editors of SHOOT within 14 business days after voting ends. The editors of SHOOT will select possible winner(s) and honorable mentions from photos with the most votes (maximum number of total votes per image is 1000).
The possible winner(s) and honorable mentions will be notified within 72 hours after selections have been decided. If the winner cannot be contacted or they do not claim the prize within 14 days of notification, producer reserves the right to withdraw the prize from the winner or pick a replacement winner.
The producer’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
The winner agrees to the use of his/her name and winning submission any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with U.S. Federal laws and will not be disclosed to a third party without the entrant’s prior consent.
ENTERING THE CONTEST/ELIGIBILITY REQUIREMENTS FOR PHOTOS/WAIVERS AND RELEASES
WHAT TO ENTER
To ensure upload speed for the contest entry form, please submit files no larger than 2MB at the time of entry. No Entries larger than 50MB will be accepted. Higher resolution files of 300 dpi/ppi will be requested should an entry be selected to be awarded a prize or an honorable mention.
Photos must be captured with either a digital camera, smartphone, or scanned from a film slide, negative or print and submitted in digital format. Entries may originate in any format — including, but not limited to digital files, digital prints, color transparencies, color prints, or black and white prints — so long as they are submitted electronically in a .JPEG .jpg, or.png form.
Entry must depict motion picture production or post behind the scenes as it appeared when shot taken. Photo(s) need not be shot professionally. Digital manipulation/enhancement is allowed as long as photographs accurately reflect the subject matter and the scene as it appeared. Fish-eye lenses are acceptable. Stitched panoramas are acceptable only if the combined parts are all made around the same time. Multiple exposures that have been combined to produce a single "High Dynamic Range" image are acceptable. Hard copy prints or slides are not accepted.
Images submission must be absent of logos and watermarks overlays.
All files should be named in the following format and must not include spaces or unusual characters, such as apostrophes, quotes, etc. An example of an eligible file name is SHOOTbtsContest_PhotograherName_PhotoNameAndOrNumber.jpg An example of an ineligible file name is SHOOT#bts,Contest/JillSmith_Prodteam2016.tif Image files that do not meet the requirements for file naming may not be accepted.
Entries should include metadata if at all possible.
Caption should include:
Short description of photo, names of any people (if any) in photo (i.e L to R), and required photo credit info.
Previously published material for which non-exclusive rights were granted may be entered as long as you still maintain the right to grant SHOOT a license (see "Your Rights" below). You must be able to disclose when and where the photo appeared previously to SHOOT upon request.
If you choose to include people in your submission, you are responsible for obtaining the necessary releases from the individuals depicted, and must be able to provide copies of those releases to SHOOT upon request.
The following submissions are ineligible:
Images not suitable for viewing by the general public 16 and up;
Photos that violate or infringe upon another person's or company's rights, including but not limited to copyright;
Photos that contain sexually explicit, nude, obscene, violent or other objectionable or inappropriate content;
Images that involve the willful harassment of wildlife, or damage to the environment by the photographer;
Images that involve putting any individual or animal in danger;
Images containing logo(s) and watermark(s) overlays.
Images taken more than three (3) years prior to the submission date of the entry;
SHOOT reserves the right to reject and remove any submissions deemed inappropriate without recourse or explanation.
HOW TO ENTER
SHOOT makes it incredibly simple to enter your BTS Photo(s). Each Entry must include all required information requested (see below) and SHOOT would prefer to have additional - non-required information - as well.
There are four easy ways to enter:
- Upload a BTS photo on MySHOOT website via http://BTS.SHOOTonline.com
- Upload a photo via the Photo Contest tab on SHOOT's’ Facebook Page (http://BTS-FB.SHOOTonline.com)
- Publicly share your BTS shot on on your Twitter account and hashtag it #MySHOOTbts (include short description of photo, names of any people (if any) in photo (i.e L to R), and required photo credit info, #MySHOOTbts to enable the Producer to identify the relevant entries.)
- Publicly share your BTS shot on your Instagram account and tag it #MySHOOTbts (include short description of photo, names of any people (if any) in photo (i.e L to R), and required photo credit info, #MySHOOTbts to enable the Producer to identify the relevant entries.)
Entries must be received by the Producer during the Contest Entry Period (see below). Entries received after the end date for the Contest period will not be accepted.
Note: Entries via Instagram, Twitter, and/or Facebook: Using the hashtag #MySHOOTbts your public BTS posts will automatically enter your photo into SHOOT's BTS contest! All tagged photos and tweets may appear on the Producer's Profile Pages on Facebook, Instagram and Twitter.

Digital images that are sent via mail or email will not be accepted. You may enter an unlimited number of times, but you may not use an agency or automated system to enter. Producer reserves the right to reject any additional entries or entries that do not comply with these Official Rules.
Entrants may be asked to supplement their submission (such as with a paragraph about their photo or the highest resolution version of their photo) anytime during or after a photo contest entry period.

When you enter the Contest on the SHOOT website or Facebook page, you may be asked to consent to receive promotional e-mails and reminders for upcoming promotions and information from SHOOT. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Contest and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mail address shall be subject to the privacy statement found on the SHOOT Website at https://SHOOTonline.com/privacy.

INTELLECTUAL PROPERTY RIGHTS
Publication and License
By submitting, you confirm that the images are lawfully yours (or your clients if agent) and you retain full copyright discretion. As between you and SHOOT, each entrant shall retain ownership of all intellectual property rights in the entry subject to these Official Rules. However, by entering the Contest, and to the extent allowed by law, entrant grants, but solely in relation to the promotion and/or advertising of the Contest and it’s print and digital displays, the Producer, the Producer's Sponsors, the Producer’s affiliates, licensees, promotional partners, developers and third party marketing entities a non-exclusive worldwide, royalty-free license, in perpetuity, to modify, rearrange, copy, reproduce and adapt the images only to fit the format required for product web pages and marketing materials; The copyright owner grants a license to publish and use the images themselves and the content of and elements embodied in the images, including any names, locations and likenesses, in perpetuity, in any and all media, including but not limited to print, digital and electronic media, computer, and audiovisual media (whether now existing or hereafter devised), in any language, throughout the world, and in any manner without further review, notice, approval, consideration, or compensation ONLY IN THE CONTEXT OF THE SHOOT "BEHIND THE SCENES" PHOTO CONTEST. Sponsors, its affiliates, partners consultants, will not commercially exploit the images and all such rights of commercial exploitation remain with entrants.
Photographs owned by a third party, are acceptable IF license has been secured to permit your submission to this contest and allows the Producer to use the images as outlined in all these rules.
If a submitted image includes other people, entrant must be prepared to provide a signed written personal release from all persons who appear in the image authorizing use of the image. Entrants do not need to send release(s) with submissions but will be contacted if personal releases are needed. Failure to provide the required releases will result in disqualification of the entry.
Work For Hire Agreements | Production Set Producer, Union and Guild Rules | Non-disclosure Pacts
SHOOT is in no way trying to infringe on the copyrights, work rules, union or guild rules or businesses of any movie, TV, commercial, other other motion picture producer(s). By entering this Contest, an entrant is indicating his/her bts photo(s), when taken, are not in violation of:
- or infringe upon another person's, company's, or union/guild rights, including but not limited to U.S. copyright law, production vendor contracts, non-disclosure agreements, and employment contracts, etc.;
- Any "work for hire" agreement or contract under under U.S. copyright law;
- guidelines and policies set by the production company and/or studio and/or advertiser/brand or other motion picture producer
When shooting production and behind-the-scenes stills on set is being performed by a designated unit still photographer, do not interfere with the work of that production employee. Make sure that any photographs you take are within the guidelines and policies set by the production company.
At the sole discretion of the Producer, photos entered in the Contest that violate or infringe upon another person's or company's rights, including but not limited to copyright or "work for hire" copyright, producer or union/guild rules are ineligible and will be disqualified from the Contest. And, Contest Producer reserves the right to reject and remove any submissions deemed in violation of a production's rules, in place at time of when photo taken, or inappropriate in nature, without recourse or explanation. And the photographer, or their agent, may be banned (see "Banning" below).
NOT AN OFFER OR CONTRACT OF EMPLOYMENT
Under no circumstances shall the submission of an entry into the Contest, the awarding of a prize, or anything in these Rules be construed as an offer or contract of employment with either the Contest producer, or the Contest sponsors. You acknowledge that you have submitted your images voluntarily and not in confidence or in trust. You acknowledge that no confidential, fiduciary, agency or other relationship or implied-in-fact contract now exists between you and the Producer or the Contest Sponsors and that no such relationship is established by your submission of images under these Rules.
Your address and contact information is kept strictly confidential. If selected as a finalist photographers name will be published unless you advise SHOOT of any concerns regarding this. SHOOT will on occasion email contest entrants pertaining to our events and publications. By entering the Contest, you are granting to the Producer permission to email you in this manner, to notify you of winning, and/or to notify you of possible problems with your entry or other contact that SHOOT deems necessary at its sole discretion.
The Producer reserves the right to prohibit entry from any person who it believes to be abusing these Contest Rules. Abuse includes entering false information, exploiting the system, copyright violations, or other unacceptable behavior. If you have been banned and wish to discuss the situation, please contact SHOOT at email@example.com.
The contest runs bi-annually (twice a year) in the summer and winter. Current and upcoming important contest dates and deadlines:
The SHOOT 2016 BTS Summer Photo Contest will commence on June 13, 2016 at 12am (midnight) Eastern Time (ET) and ends on September 13th, 2016 at 11:59pm Eastern Time (ET) (the Summer Contest Entry Period).
The SHOOT 2016/17 BTS Winter Photo Contest will commence on December 1st, 2016 at 12am (midnight) Eastern Time (ET) and end on March 1st at 11:59pm Eastern Time (ET) (the Winter Contest Period).
VOTING, JUDGING and NOTIFICATION OF WINNER(S)
The potential winner(s) will be notified by telephone, mail, and/or email on or about one (1) weekday after winner selections have been made and will be given five (14) calendar days to confirm receipt of notification. SHOOT will notify the winner via the contact information provided at the time of entry. SHOOT will make its best efforts possible to contact possible winners, but to be clear, notification is deemed to have occurred immediately upon placing of a phone call or sending of an email to contact a possible winner.
The use of third-party software or website or automated entry systems to participate and vote in this Contest in any way is prohibited. Automated, script, macro or robotic votes will be disqualified.
Photos will be judged on originality, composition, overall impact, artistic merit and subject matter relevance to behind the scenes of motion picture production and post of movies, TV, Commercials, Music Videos, etc. Judging will be conducted by the editors of SHOOT Magazine and SHOOTonline.com.
"Vote to win," “like to win” or “comment to win” The editors of SHOOT will select winner(s) and honorable mentions from photos with the most votes (maximum number of total votes per image is 1000). 1 person voting for 100 days, or 100 people voting in 1 day equal the same results. Voting is a simple click vote once per day. Anyone can vote on an image for free and keep revisiting each day to do so. Along with the Votes made at http://BTS.SHOOTonline.com and via SHOOT's’ Facebook App Page, Likes and retweets counts will be added in as well from Facebook, Instagram or Twitter and Comments on your Facebook, Instagram or Twitter will also be reviewed.
All judging decisions are final. Please do not contact SHOOT about the status of entries or judging.
SHOOT will notify the possible winner(s) via the contact information provided at the time of entry.
Possible winners may be required to provide SHOOT with proof that he or she is owner of email address associated with the winning entries.
ODDS OF WINNING
Odds of winning a prize depend on the number of eligible entries received during the Entry Period.
PRIZES, DELIVERY, and NOTIFICATION
These are only general prize rules. Only the selected possible winners and honorable mentions will be notified by email or phone.
Prizes will be shipped within 90 days of the winner's announcement to those addresses provided by Contest winner and Honorable Mentions and will include only those delivery guarantees provided by U.S. Postal Service. You can be located anywhere within the world to participate, except where excluded, but we can only pay for shipping prizes to US and Canadian addresses. Additional shipping costs and instructions will be requested, if applicable, to winner or honorable mentions if outside the U.S. and Canada.
Producer reserves the right to substitute a prize, in whole or in part, of equal or greater monetary value if a prize cannot be awarded, in whole or in part, as described for any reason, including export laws. Value is subject to market conditions, which can fluctuate and any difference between actual market value and actual retail value will not be awarded. Producer has not made are not responsible in any manner for any warranties, representations, or guarantees, express or implied, in fact or law, relating to the prize, regarding the use, value or enjoyment of the prize, including, without limitation, its quality, mechanical condition, merchant-ability, or fitness for a particular purpose, with the exception of any standard manufacturer's warranty that may apply to the prize or any components thereto.
The SHOOT will award the following prizes.
One (1) overall grand prize winner will receive: $500 USD Photo published on the cover of SHOOT magazine and photo feature inside the issue. Placement on SHOOTonline.com's homepage and on all SHOOT digital ePubs including SHOOT Dailies, SHOOT >e.dition, SHOOT Screenwork and The SHOOT >e.dition. 1 year PRO membership SHOOTonline.com.

Any prize details not specified above will be determined by SHOOT, in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.
The size, design, issue, and content of the cover and feature is chosen completely by SHOOT Magazine. If the winner does not want to be featured or receive prizes, there are no substitutions. After the winner declines, the Prize will be forfeited and awarded to an alternate winner selected from all of the remaining eligible entries that meet the Judging Criteria. The SHOOT magazine is printed and distributed at the discretion and timeline of DCA Business Media LLC.
All winners are responsible for paying any income taxes and any and all other costs and expenses not listed above. If the prize value equals or exceeds $600, a winner who is a U.S. resident will need to complete, sign and return an IRS W-9 form prior the award of any prize. Payments to potential winners are subject to the express requirement that they submit to the sponsor all documentation requested by the sponsor to permit it to comply with all applicable federal, state, provincial, local and foreign tax reporting and withholding requirements. All prizes will be net of any taxes sponsor is required by law to withhold. All taxes imposed on prizes are the sole responsibility of the winners.
In order to receive a prize, potential winners must submit the tax documentation requested by producer or otherwise required by applicable law, to producer or the relevant tax authority, all as determined by applicable law, including, where relevant, the law of the potential winner’s country of residence. The potential winners and finalists are responsible for ensuring that they comply with all the applicable tax laws and filing requirements. If a potential winner or finalist fails to provide such documentation or comply with such laws, the prize may be forfeited and SHOOT may, in its sole discretion, select an alternative potential winner.
LIMITATION OF LIABILITY
By entering, Entrant releases and holds harmless Contest producer and any and all Contest Sponsors, Facebook, their respective parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising out of participation in the SHOOT BTS Photo Contest or receipt or use of any prize, and related activities. The entrant shall not assert against any party Producing or Sponsoring the Contest any claim of any kind whatsoever regarding the image including, but not limited to, actions based on copyright, moral rights, or trademark infringement, passing-off, misappropriation of personality, invasion of privacy, publicity or defamation. You waive the right to claim any attorneys fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
Producer is not responsible for:
unauthorized human intervention in the Photo Contest;
any typographical or other error in an Entrant’s submission(s), printing of the offer, Contest administration, or the announcement of winners and prizes;
any electronic transmission errors resulting in interruption, deletion, delay, destruction, or unauthorized access to or alterations of entry materials;
any technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive Submission information on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof.

SHOOT cannot be held liable for any failure of its websites during the Contest. SHOOT is not responsible for loss, damage, technical problems or delays that may occur during digital transfer of images.
SHOOT is not responsible for technical failures on the part of Contest software or human error which could result in inaccurate postings and notifications or for email or phone notifications that are rejected or do not reach a selected entrant.
MODIFICATIONS OF RULES/TERMS OF SERVICE
Producer reserves the right to make modifications to the Rules/Terms of Service. Changes made to the Rules/Terms will be posted on the website in this section or notification will be sent to users by email. Continued use of the website constitutes acceptance of those changes.
RIGHT TO CANCEL OR SUSPEND CONTEST
If the Contest is not capable of running as planned, due to a computer virus, bug, worm, Trojan Horse, tampering, fraud, technical failures, or any other causes beyond the Producer’s control that adversely affect the administration, security, or fairness, of the Contest, the Producer reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and to cancel, modify, or suspend the Contest or any aspect thereof. The Producer will not retain any rights in the submitted images and will return the fees (if any) submitted with each entry if the Contest is canceled or terminated.
JURISDICTION OF LAW
The Contest is governed by the laws of the State of Connecticut and U.S. Federal Law. Entrants consent to personal jurisdiction in Connecticut courts for any dispute or litigation arising from or relating to the Contest.
To the extent permitted by law, Entrant waives the right to litigate, to seek injunctive relief, or any other judicial or procedural recourse of a dispute or claim arising from or relating to this Contest.
POTENTIAL WINNER REQUIREMENTS
Except where prohibited, a potential winner may be required to complete and return an affidavit of eligibility, including proof of age, and liability/publicity release within 14 days. If a potential winner is a minor, his/her parent or legal guardian will be required to sign the documents on his/her behalf. If a potential winner fails to return these documents on time, an alternate potential winner may be selected in his/her place.

Display the photograph anywhere deemed appropriate, by SHOOT, on the Photo Contest submission website (https://My.SHOOTonline.com), on https://SHOOTonline.com, and any related sub-sites of https://SHOOTonline.com.
Display the photograph on SHOOT's Photo Contest Facebook page under tab "BTS Photo Contest"
Allow third-parties to share the photograph on any and all social media platforms: Twitter, Facebook, Google+, Pinterest, Stage 32, etc.
If your photograph is formally selected as a winner, runner-up or an honorable mention, you grant SHOOT a royalty-free, nonexclusive right, in perpetuity, to:
Use the photograph on the Internet and in Social Media in support of SHOOT's BTS photo contest.
Use the photograph in SHOOT's internal and external communications materials including but not limited to web sites and web publications, fact sheets, advertising, multimedia, presentation and membership services, and SHOOT magazine.
Provide your photograph to other individuals and organizations for Contest-related PR use in news stories, newsletters, reports, slide shows, displays, web pages, videos, membership premiums, and the like.
Use, in connection with the Photo Contest, photographer's name in promotions and other publications.
Retain a digital copy of your photograph that will be archived in the SHOOTonline database and accessible to SHOOT staff, 3rd party SHOOT authorized agencies, and SHOOT members.
SHOOT will endeavor to credit all photographs with the caption "Photographer's Name" when the full name is available.
In the event that the operation, security, or administration of the Photo Contest is impaired in any way, Producer may, in its sole discretion, either: (a) suspend the Photo Contest to address the impairment and then resume the Photo Contest; or (b) award the prize(s) from among the eligible entries received up to the time of the impairment. Producer reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Photo Contest, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Producer’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the owner of an online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. The Photo Contest is subject to federal, state, and local laws and regulations and is void where prohibited.
RELEASE AND LIMITATIONS OF LIABILITY
By entering, you agree to release and hold harmless Producer, Sponsors, Facebook, their respective parent, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Photo Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Photo Contest; (b) technical errors; (c) printing errors; (d) late or undelivered mail; (e) errors in the administration of the Photo Contest; or (f) injury or damage to persons or property. You waive the right to claim any attorneys fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
When you enter, you will automatically become a subscriber on SHOOT's Featured Offers List. This includes special event invitations, digital messages and special offers occasionally from SHOOT. You may cancel and unsubscribe at any time at the bottom of any SHOOT Featured Offer email.
PRIVACY AND PUBLICITY
You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Photo Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Connecticut. All issues and questions concerning the construction, validity, interpretation and enforce-ability of these Official Rules, your rights and obligations, or the rights and obligations of Producer in connection with the Photo Contest, shall be governed by, and construed in accordance with, the laws of Connecticut, without giving effect to any choice of law or conflict of law rules (whether of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Connecticut. Proof of sending any communication to Producer by mail shall not be deemed proof of receipt of that communication by Producer.
To request a winners list, send a self-addressed, stamped envelope with your request to SHOOT, Behind The Scenes Digital Photo Contest, 256 Post Road East, Westport, Suite 203, Westport, CT 06880. Requests must be received by within three (3) months after winners announced.
By submitting a Entry you warrant and represent that the Entry is an original work, created solely by you (or by yourself and others who have each granted you authority to license the rights stated herein), and that the use of the Entry as licensed here under does not infringe on any third party’s intellectual property rights, including copyrights, trademarks, work for hire or other proprietary or personal rights. You warrant and represent that the Entry does not contain defamatory, inaccurate, abusive, obscene, profane, sexually oriented, or threatening material. The Entry submitted shall be photo that you own or control 100% of the rights to the publishing. The Entry shall be free and clear of any claims by any person whose performances or depictions are embodied in the work, or any person rendering services in connection with the work. The Entry shall not contain any materials owned or controlled by a third party for which you have not obtained a license. Producer reserves the right to remove an Entry that it deems to be in violation of these Official Rules.
